June 1st, 2022 Retail Warranty Policy
1.
Sherwood’s
Forest will warrant Hardy Landscape plant material
at 50% of purchase cost for 6 Months from the date of retail
purchase. Warranty Not
transferable. (One
replacement only). Delivery
cost not included in warranty.
2.
No warranty on annuals,
house plants. Perennials, crepe myrtle mums, roses, seasonal flowers,
bulbs, seed, sod, ground covers or tropical flowering plants.
No Warranty on Sale Plants
3.
Warranty is honored when
customer presents to Sherwood’s
Forest
sales receipt, plant tag, and dead plant.
4.
All exterior trees, and
shrubs planted by Sherwood’s Forest in a residential setting are
guaranteed with a 50% replacement cost for 1 years from the date of
installation, including labor. (One
replacement only).
5.
All commercial project
plantings are guaranteed 50% of purchase cost for one year from date of
installation; please note exceptions in item 2 above and item 6.
6.
Warranty exceptions are
actions beyond anyone’s control such as fire, theft, vandalism,
weather extremes, acts of God, DEER OR ANIMAL DAMAGE or improper care
and maintenance.
7.
No warranty on wholesale
purchases.
8.
No Cash Refunds-Customer
may have merchandise credit for the 50% of amount paid for the plant or
plant replacement of equal cost of original purchase price.
9.
Owner agrees to maintain
the landscape material sold herein, as per instructions from
Sherwood’s or warranty is void.
10.The
Owner will be responsible for locating all owner owned underground
utility lines, i.e., irrigation lines, invisible dog fences, low voltage
and 110 voltage lighting systems, natural gas lines feeding gas grills,
natural gas lights and swimming pool heaters, swimming pool plumbing
lines and electrical lines which may interfere with the planting
process. Any utility not
properly located and flagged and shown to Sherwood personnel which
becomes damaged will not be Sherwood’s
Forest
responsibility. Sherwood’s
Forest
will not be responsible for any resulting difficulties or traumas that
may develop because of this problem.
11.Sherwood’s
Forest
will contact Missouri One Call to have all utilities participating in
the One Call service, located. This
service locates gas, electric, phone, cable, and other utilities but
only to the homeowner’s meters, nothing beyond that point. (See item
10 above)
12.The
parameters of this contract shall include all the items expressly
written in this contract, as well as any handwritten or noted changes
agreed to by the client and Sherwood’s
Forest
. Sherwood’s
Forest
makes no implications to cover or include any items not specifically
described in this contract. No verbal arrangements will be covered by
this agreement unless expressly written into this contract.
13.Accounts
are due as specified on front of this contract, otherwise, all accounts
over 30 days past due are subject to 1.5 % service charge for every
month past due. Any accounts
over 90 days, will be subject to lawful prosecution and filing of
mechanic’s lien. Owner
will be responsible to pay all collection costs.
14.
In cases where a contracted
project completion has been delayed by construction, weather, or
conditions beyond the control of Sherwood’s Forest, Sherwood’s
Forest
will expect to be paid for all work that has been completed up until the
stop date. Resumption of work will occur as quickly as the construction
site situation improves to allow the timely completion of the contracted
services.
NOTICE TO OWNER
FAILURE
OF THIS CONTRACTOR TO PAY PERSONS SUPPLYING MATERIALS OR SERVICES TO
COMPLETE THIS CONTRACT CAN RESULT IN THE FILING OF A MECHANIC’S
LIEN
ON
THE PROPERTY WHICH IS THE SUBJECT OF THIS CONTRACT PURSUANT TO CHAPTER
429 RSM0. TO AVOID THIS
RESULT, YOU MAY ASK THIS CONTRACTOR FOR “LIEN WAIVERS” FROM ALL
PERSONS SUPPLYING MATERIAL OR SERVICES FOR THE WORK DESCRIBED IN THIS
CONTRACT. FAILURE TO SECURE
LIEN WAIVERS MAY RESULT IN YOUR PAYING FOR LABOR AND MATERIALS TWICE.
